Construction Workers In Ireland Must Transfer UK CSCS Cards To Meet Regulations & Insurance Requirements

We would like to draw your attention to an important matter concerning construction workers in Ireland who hold UK based CSCS cards. The Health & Safety Authority (HSA) have advised that they have come across workers holding UK issued cards on site who have not transferred them over to the Irish CSCS cards. We would like to emphasise that the UK-issued cards are not recognised under the Safety, Health and Welfare at Work (Construction) Regulations. Consequently, workers who fail to transfer their cards to Irish CSCS cards are in breach of the Regulations.
The HSA has advised they will commence enforcement of these regulations, which will result in workers being unable to work until their cards are regularised. To assist in this process, the HSA recommends that holders of UK cards address this matter as a priority.
Furthermore, we would like to remind all brokers that most construction policies in the Irish market include a condition relating to the Insured’s duty to comply with all statutory obligations and regulations. It is essential that you ensure your construction clients are aware of any such condition and are taking all reasonable precautions before allowing employees on-site. Failure to comply with this condition may result in the invalidation of a claim.
